Do you need a lawyer for a New Jersey traffic ticket? The NJ Courts do not say you must have one. They say you have the right to hire one, and in some cases the court may assign one. Here is what the official court pages say, in plain words.

Do you have to hire a lawyer for a NJ traffic ticket?

No rule on the NJ Courts pages says every ticket needs a lawyer. In the Municipal Court you may speak for yourself. The NJ Courts list "You have the right to retain an attorney" as one of your rights as a defendant.

Can the court give you a lawyer?

The NJ Courts say you have the right to be assigned an attorney if the judge decides you cannot afford one and there is a likelihood that, if you are convicted, you will go to jail, receive a substantial fine or lose your driver's license. For some serious charges you may apply for a public defender. See the official Municipal Court page.

What do you give up if you just pay the ticket?

If you pay without going to court, that is a guilty plea. You give up your right to a lawyer and your right to a trial. Read pay or plead not guilty before you decide.

What rights do you have in court?

The NJ Courts list these rights for a defendant in Municipal Court:

  • You are presumed innocent until proven guilty beyond a reasonable doubt.
  • You have the right to be told the charges against you.
  • You have the right to remain silent.
  • You may ask for a reasonable postponement to talk to an attorney and prepare.
  • You may testify or not, and call witnesses.
  • You may appeal within 20 days of a conviction.

What is a plea agreement?

A plea agreement is a way to settle a case, worked out with the municipal prosecutor. You are not required to talk to the prosecutor, and the judge must approve every plea agreement. Some tickets can also be handled online; see NJMCdirect explained.

What if you need more time to find a lawyer?

The NJ Courts say a case may be postponed so you can get a private attorney, or a public defender if you qualify. Ask the court staff how to request it. Do not skip your court date. See what happens if you miss a court date.
